To the maximum extent permitted by law, the app's creators, affiliates, and partners disclaim and are not liable for any losses, fines, penalties, injuries, damages, or claims arising from use or misuse of the app or reliance on its outputs, whether direct, indirect, incidental, consequential, or punitive.

User Responsibility and Assumption of Risk

By using BAC Battle, you acknowledge and agree that:

• You use the app at your own risk
• You are solely responsible for all decisions you make regarding alcohol consumption
• You will never use the app's BAC estimates to determine fitness to drive
• You understand the app is for entertainment only
• You will comply with all applicable laws and regulations regarding alcohol consumption
• You are of legal drinking age in your jurisdiction

Indemnification

User will defend, indemnify, and hold the app's creators, affiliates, and partners harmless from third-party claims arising from user conduct or breach of this waiver.

Service Suspension and Termination

The app may suspend or terminate access for violations, and this waiver applies to all versions of the app and related services provided now or in the future.

Electronic Acceptance

Acceptance is provided electronically, and the user consents to electronic records and signatures with legal effect under the ESIGN Act and UETA, as applicable.

Severability and Updates

If any term is found unenforceable, the remainder will continue in effect to the fullest extent permitted by law, and the app may update this waiver with notice and renewed acceptance as required.

Limitation of Damages

In no event shall the app's creators, developers, or affiliates be liable for any damages whatsoever, including but not limited to:

• Personal injury or death
• Property damage
• Legal fees and fines
• Loss of driving privileges
• Criminal or civil penalties
• Any other direct, indirect, incidental, special, or consequential damages

Acknowledgment and Agreement

By using BAC Battle, you acknowledge that you have read, understood, and agree to be bound by this Safety and Liability Waiver. If you do not agree with any part of this waiver, you must not use the app.
